This Privacy Policy describes how FormAce ("we", "us", or "our") collects, uses, stores, and shares your information when you use our mobile application and web platform (collectively, the "Service"). By using FormAce, you agree to the collection and use of information in accordance with this policy.
1. Information We Collect
We collect the following categories of information:
1.1 Information You Provide
Account Information: When you create an account, we collect your name, email address, and password. If you sign in via a third-party provider (e.g., Google), we receive basic profile information from that provider.
Profile Information: You may optionally provide additional details such as your skill level, dominant hand, and tennis goals to personalize your experience.
Payment Information: If you subscribe to a paid plan, billing details are collected and processed by Stripe. We do not store your full credit card number or financial information on our servers.
Support Communications: If you contact us for support, we retain those communications to resolve your issue and improve our service.
1.2 Camera and Video Data
FormAce requests access to your device's camera to enable you to record tennis footage directly within the app. Camera access is used solely for the following purposes:
Video Recording: To capture video of your tennis form for analysis.
AI Form Analysis: Recorded videos are uploaded to our servers and processed by our AI pipeline to generate posture, technique, and performance feedback.
Storage: Videos are stored securely in Firebase Cloud Storage and are accessible only to you and, where applicable, coaches or other users you explicitly share them with.
Camera access is requested only when you initiate a recording session. We do not access your camera in the background or without your knowledge. You may revoke camera permission at any time through your device settings; however, doing so will prevent video recording features from functioning.
1.3 Usage and Device Information
Usage Data: We automatically collect information about how you interact with the Service, including features used, screens visited, session duration, and actions taken within the app.
Device Information: We collect information about the device you use to access the Service, including device model, operating system version, unique device identifiers, and mobile network information.
Log Data: Our servers automatically record information including your IP address, browser type, pages visited, and timestamps when you access the Service.
2. How We Use Your Information
We use the information we collect to:
Provide the Service: Deliver AI-powered tennis form analysis, generate performance reports, track your progress over time, and surface personalized coaching recommendations.
Improve Our Algorithms: Analyze aggregated and anonymized video data and usage patterns to improve the accuracy and quality of our AI analysis models. We will only use your identifiable video data for model training if you have explicitly opted in.
Account Management: Create and manage your account, authenticate your identity, and process transactions.
Communications: Send you service-related notifications, updates about your analysis results, and, with your consent, promotional communications. You may opt out of marketing emails at any time.
Safety and Security: Monitor for fraudulent activity, enforce our Terms of Service, and protect the rights and safety of our users.
Legal Compliance: Comply with applicable laws, regulations, and legal processes.
3. How We Share Your Information
We do not sell your personal information. We share your data only in the following circumstances:
Service Providers: We share information with trusted third-party vendors who help us operate the Service (see Section 5). These parties are contractually bound to use your data only to provide services to us and in accordance with this policy.
With Your Consent: If you share a video or analysis report with a coach or another user, that content becomes accessible to them.
Legal Requirements: We may disclose your information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will notify you before your data is transferred and becomes subject to a different privacy policy.
4. Data Retention
We retain your personal information and video data for as long as your account is active or as needed to provide the Service. You may delete individual videos at any time from within the app. If you delete your account, we will delete or anonymize your personal data within 30 days, except where retention is required by law or for legitimate business purposes such as resolving disputes or enforcing agreements.
5. Third-Party Services
We use the following third-party services, each of which has its own privacy policy and data practices:
Firebase (Google LLC): Used for user authentication, Firestore database storage, video storage (Cloud Storage), and cloud functions. Firebase is subject to Google's Privacy Policy.
Stripe, Inc.: Used for payment processing. Stripe collects and processes payment card data in accordance with PCI-DSS standards and its own Privacy Policy.
AI Analysis Services: Video frames and data may be processed by AI inference services to generate form analysis. These services process data on our behalf and are contractually prohibited from using your data for their own purposes.
Analytics: We may use analytics tools to understand aggregate usage patterns and improve the app. Such tools receive anonymized or pseudonymized data only.
6. Data Security
We implement industry-standard security measures to protect your information, including:
Encryption in Transit: All data transmitted between your device and our servers is encrypted using TLS/HTTPS.
Encryption at Rest: Video files and sensitive user data stored in Firebase are encrypted at rest.
Access Controls: Access to user data is restricted to authorized personnel on a need-to-know basis. Authentication tokens and secrets are stored securely and never exposed in client-side code.
Security Rules: Firebase Security Rules enforce that users can only access their own data.
Despite these measures, no method of transmission or storage is 100% secure. We cannot guarantee absolute security, and you use the Service at your own risk. Please notify us immediately at privacy@formace.ai if you suspect any unauthorized access to your account.
7. Your Rights and Choices
Depending on your location, you may have the following rights regarding your personal data:
Access: Request a copy of the personal data we hold about you.
Correction: Request that we correct inaccurate or incomplete information.
Deletion: Request that we delete your account and associated personal data. You can initiate account deletion from the app's profile settings or by contacting us.
Portability: Request a machine-readable export of your data.
Opt-Out of Marketing: Unsubscribe from promotional emails at any time using the link in any marketing email or by contacting us.
Camera Permission: Revoke camera access at any time via your device's app settings.

8. GDPR — Rights for EEA Users
If you are located in the European Economic Area, you have additional rights under the General Data Protection Regulation (GDPR), including the right to lodge a complaint with your local supervisory authority. Our legal bases for processing your data are: performance of a contract (providing the Service), legitimate interests (security, fraud prevention, service improvement), and consent (marketing communications, optional data uses).
9. CCPA — Rights for California Residents
If you are a California resident, you have the right to know what personal information we collect, disclose, or sell; the right to request deletion of your personal information; and the right not to be discriminated against for exercising these rights. 10. Children's Privacy
FormAce is not directed to children under the age of 13 (or 16 in the EEA). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal data without parental consent, we will take steps to delete that information. If you believe a child has provided us with their data, please contact us at privacy@formace.ai.
11. International Data Transfers
Your information may be transferred to and processed in countries other than your own, including the United States, where our servers and service providers are located. We ensure that such transfers are conducted in accordance with applicable data protection laws and that appropriate safeguards are in place.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification or displaying a prominent notice within the app. We encourage you to review this policy periodically. Your continued use of the Service after changes become effective constitutes your acceptance of the revised policy.
