End User License Agreement

This End User License Agreement ("EULA") governs your use of the FormAce mobile application, website, and related services (collectively, the "Service"). By downloading, installing, accessing, subscribing to, or using FormAce, you agree to this EULA and our Terms of Service.

1. License

FormAce grants you a limited, non-exclusive, non-transferable, revocable license to install and use the FormAce app for personal, coaching, family, team, or academy use, subject to this EULA, our Terms of Service, and all applicable laws.

2. Ownership

FormAce and its software, design, branding, analysis formats, recommendations, and related materials are owned by FormAce or its licensors. This EULA does not transfer ownership of the app, technology, or intellectual property to you.

3. User Content

You retain ownership of videos, images, notes, and other content you upload. You grant FormAce a limited license to host, process, transmit, display, and analyze that content as needed to provide, maintain, secure, and improve the Service. You are responsible for obtaining any required consent before uploading videos or personal data involving another person, including minors, students, players, or team members.

4. Subscriptions and Auto-Renewal

Some FormAce features require an auto-renewable subscription. Subscription prices, billing periods, included video analysis limits, and available features are shown before purchase. Payment is charged to your Apple ID account at confirmation of purchase.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings. Cancellation stops future renewals but does not automatically refund previous charges unless required by law or Apple's policies.

5. Acceptable Use

You may not misuse FormAce, attempt unauthorized access, reverse engineer protected systems, interfere with the Service, upload malicious files, violate another person's privacy or rights, or use FormAce for unlawful purposes.

6. AI Analysis and Athletic Risk

FormAce provides informational and educational tennis form analysis. AI-generated results may be incomplete, inaccurate, or vary based on video quality, camera angle, lighting, player visibility, and model limitations. FormAce is not medical advice, physical therapy, injury diagnosis, or a substitute for qualified coaching or medical guidance.

Tennis and athletic training involve risk. You are responsible for training safely, using appropriate equipment, warming up, stopping activity if you feel pain, and seeking professional medical advice when needed.

7. Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using FormAce, you also agree to the practices described in our Privacy Policy.

8. Updates and Availability

FormAce may provide updates, fixes, or changes to the app and may modify, suspend, or discontinue parts of the Service at any time. Some features may require an internet connection and compatible device software.

9. Termination

We may suspend or terminate your access to FormAce if you violate this EULA, our Terms of Service, fail to pay required fees, create risk for FormAce or other users, or use the Service unlawfully. You may stop using FormAce at any time.

10. Disclaimers and Limitation of Liability

FormAce is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law. We do not guarantee that analyses will be error-free, uninterrupted, or suitable for every player or training situation.

To the fullest extent permitted by law, FormAce will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, training injuries, or performance outcomes arising from your use of the Service.

11. Apple Terms

If you downloaded FormAce from the Apple App Store, Apple and its subsidiaries are third party beneficiaries of this EULA and may enforce this EULA against you as a third party beneficiary. Apple is not responsible for providing maintenance or support services for FormAce.
